These Terms govern your use of Retro Commander ("the app"), an independent software product operated by Jarno Beumer, Netherlands ("we", "us"). By creating an account, starting the trial, or purchasing a licence you agree to these Terms. If you do not agree, do not use the app.
We grant you a personal, non-exclusive, non-transferable licence to install and use the app on the number of devices permitted by your tier. The software is licensed, not sold; we retain all intellectual property rights in it.
New accounts receive a 14-day free trial of the paid features. When the trial ends, unpurchased accounts fall back to the free tier (with a capped session length). The trial is offered once per account.
Purchases are sold and processed by Creem (Armitage Labs OÜ, Estonia), acting as our Merchant of Record. Creem is the seller of record, issues your receipt, and is responsible for billing and tax. Your purchase is also subject to Creem's terms. Refunds are handled as described in our Refund Policy.
Each tier permits a set number of activated devices. Self-service device management is available in the app under Settings ▸ Account. You may not share your account, circumvent device limits, or attempt to defeat licensing, rate-limiting or anti-abuse measures.
You agree to use the app lawfully and not to use it to infringe the rights of others. You are solely responsible for the legality of any software, disk images or files you transfer to or from your hardware using the app.
Retro Commander is an independent project and is not affiliated with, authorised by, or endorsed by Commodore or Gideon's Logic B.V. "Ultimate-64", "Ultimate-II+", "C64 Ultimate", "Commodore" and "C64" are trademarks of their respective owners and are used only to describe compatibility.
The app is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law. We do not warrant that it will be uninterrupted or error-free. Nothing in these Terms limits your mandatory statutory consumer rights.
To the maximum extent permitted by law, we are not liable for indirect or consequential damages, or for loss of data arising from your use of the app. Our total liability for any claim is limited to the amount you paid for your licence in the 12 months before the claim.
We may suspend or terminate an account that breaches these Terms or engages in abuse or fraud. You may stop using the app and request account deletion at any time via support@datucker.nl.
These Terms are governed by the laws of the Netherlands, without prejudice to mandatory consumer-protection rules of your country of residence. We may update these Terms; material changes are reflected by the "last updated" date and, where appropriate, announced in the app. Questions: support@datucker.nl.
